Just the same, if it the attorney's fees were 40% and this guy received less than half the settlement amount that means that OVER 10% would have gone to expenses for the preparation of the case. That's over $30,000 and that seems a bit high. His future Med expenses are supposed to come out of his settlement money.

So what was the money spent on? Additionally, if you're paying a retainer and you're paying the bill that's not exactly pro bono which is exactly the arrangement that the inmate above in all likelihood had (most inmates don't have cash... or a job that pays, etc). You get a better deal when you can afford to pay up front. You lose bargaining power when you can't.
I work in closely with attorneys every day and it is my job to follow very closely all things in atty/client meetings as well as being an active part of depositions and trials. In fact, I also sit in when the client and the attorney discuss the pro bono contract. The attorney does indeed get his jone$ in the range I specified above and the client does indeed pay the expenses I listed as well. In pro bono cases where a contract is negotiated at 33-40% of the settlement hours are not billed b/c that's part of the deal. Second, you don't seem to understand the term pro bono.. Pro bono work is done completely free of charge, with no payment to the attorney whatsoever. I believe the term contingent lawyer is the one you're looking for, they are the ones you hear about that "only get paid when you do."
Either way, whether it be contingent or per diem, the things I mentioned above (depositions hours, jury selection hours, interviewing witnesses hours, etc) are still billed to the attorney. If the attorney decided he/she was going to be paid on a percentage basis, that's fine, the attorney still absorbs those costs though.

As far as everything else you wrote: you're wrong. If the attorney was to take 33-40% AND bill for hours there would be NOTHING left. Chumpy attorneys will charge $175/hr. but then they aren't the ones who would be trying a civil matter like that (except in JP court for "chump change"). The firms I work with charge $250/hr on the low end and $600/hr on the high end (V&E, e.g.). On contingency attorneys don't bill for hours at depos or otherwise; that's what the 33-40% is for. They do charge for court reporters, expert witnesses, videographers, interpreters, etc ad nauseum. I told the attorney I was working with about our little chat and he (no big surprise) told me I was right. That, however, was before you got yourself a little attitude. Man, you get mad at the drop of a hat, don't you. Take all that money from your little auto accident settlement and get yourself some self-control. See ya.

- smotpoker, on 11/19/2008, -0/+2This is the direct result of profiteering legal system and local governments, just like 90+% of other corrections facility problems (lacking/inadequate legal representation, lacking/inadequate food preparation, unsanitary living conditions, lacking/inadequate guard training/oversight/prosecution, labor exploitation, improper jury selection/instruction, unjust extortion of plea bargains, lengthy/expensive appeals and complaints processes, etc). It's almost as disgusting as profiteering medical system but hey, as long as fatcat CEOs keep getting richer, everyone benefits, right?

First of all, the lawyer's "share" of the settlement also includes the funds necessary to pay experts and prepare exhibits/evidence for trial, as well as court costs and other fees associated with the lawsuit. So the lawyer's contingency fee was probably something like 1/3 or 2/5, not 1/2. Second, I'm pretty sure he agreed to that contingency fee when he hired the lawyer. If he was that concerned about the money, he could have gone with a different attorney who charges closer to a 1/4 contingency fee.
